Terms and Conditions
This document outlines the Terms and Conditions of Fairies Nanny Agency (the “Agency”) and the Client (employer). By engaging the Agency’s services, the Client acknowledges and agrees to the following terms.
1. Definition of Client
The “Client” refers to any individual who contacts Fairies Nanny Agency, either verbally or in writing, to request assistance in introducing a nanny, maternity nurse, mother’s help, or any other childcare professional (hereafter referred to as the “Candidate”) for potential employment.
2. Acceptance of Terms
By registering with Fairies Nanny Agency, the Client acknowledges and agrees to abide by the terms and conditions outlined in this document.
3. Service Provided
Candidate Introduction
Fairies Nanny Agency will introduce Candidates to the Client for potential employment based on the Client’s specific requirements.
Engagement Notification
If the Client decides to hire a Candidate introduced by Fairies Nanny Agency, they must notify the Agency immediately and will be required to pay a placement fee.
Confidentiality of Introductions
The introduction of Candidates by Fairies Nanny Agency is confidential. Each introduction is unique and exclusive to the specific Client and may not be shared or disclosed.
Placement Fee Payment
If the Client decides to hire a Candidate, they are responsible for paying the full placement fee as outlined in Fairies Nanny Agency’s fee structure. An additional, non-refundable £300 administrative fee also applies.
4. Candidate Suitability
Fairies Nanny Agency strives to introduce suitable Candidates based on the information provided by the Client. However, the Agency does not guarantee the suitability of any Candidate in terms of character, honesty, reliability, or professional capability.
5. DBS Checks and First Aid Certification
DBS Checks
All nannies applying to Fairies Nanny Agency must undergo DBS (Disclosure and Barring Service) checks to ensure safety and security.
First Aid Certification
All Candidates must hold a valid Pediatric First Aid certificate or be willing to obtain one. Fairies Nanny Agency offers first aid certification courses for permanent Candidates who successfully complete placement with a Client.
6. Refund Policy
If a Candidate hired by the Client for a permanent position does not remain employed for at least four weeks, or if the Client terminates employment within this period, Fairies Nanny Agency will issue a refund of the placement fee, excluding an administrative fee.
7. Employment Terms and Client Responsibilities
Hiring Basis
Clients who hire Candidates through Fairies Nanny Agency are responsible for hiring on either an employment or self-employment basis, as applicable.
Employment Contract
The Client holds full responsibility for arranging and finalizing an employment contract with the Candidate. Once the contract between the Client and Candidate is formalized, the Client must submit a copy to Fairies Nanny Agency.
Travel Expenses for Non-London Hires
If the Client hires a Candidate outside of London, they are responsible for covering any return travel expenses incurred by the Candidate.
Tax and Insurance Deductions
The Client is fully responsible for handling any applicable employee tax and national insurance deductions for the Candidate.
8. Liability
Fairies Nanny Agency is not liable for any losses, damages, or personal injuries arising from the employment of a Candidate or any negligence on the Client’s or Candidate’s part.
9. Our Commitment
Fairies Nanny Agency aims to provide a seamless and complete service to Clients, simplifying the process of finding childcare support, and remains available to assist Clients as needed.
10. Acknowledgment
All Clients engaging Fairies Nanny Agency’s services acknowledge these terms as binding upon registration.
